At some point, the adjuster may want to hear from you, their insured customer. This is the dreaded “recorded statement” time where the insurance company will ask you questions about what happened and take a voice recording of your answers. Ben Padgett Law will guide you about what to say and what not to say. In some instances, we may do a conference call to be by your side during the recorded statement. We prepare you so that you know what you need to do and say.
If your accident happened in a way that causes doubt about who caused the accident, the insurance company will use your recorded statement, the police report, witness statements, photos from the accident, and any other evidence to decide who caused the accident. This may not be a fast investigation process. During this process, they will go through the details of your recorded statement to usually try to find reasons to pay as little money as they possibly can. That’s what insurance companies do. They don’t stay in business to pay out generous amounts of money. They want reasons to refuse to pay any money (denying your claim).
If you did cause the accident and assuming you did not confess to the insurance adjuster as if they were your priest at church, there may still be hope. The insurance investigation works to assign a percentage of liability to either party…meaning, you might only be 10% at fault and not 100% at fault of causing the accident. This is where hiring Ben Padgett Law pays off. We fight and negotiate hard for you to get your percentage of fault as low as possible.
After liability is determined, we go through a process of negotiations with the insurance company. If you followed our advice, this can go smoothly. If you said the wrong thing to police or the insurance adjuster, expect this road to have bumps. At Ben Padgett Law, we have handled many cases and we have developed our own secret strategies and solutions for a challenging case, so don’t worry.
